Terms of Service (ToS) for Calahost Web Hosting

Welcome to Calahost! These Terms of Service ("Terms") govern your use of our web hosting services. By signing up for an account and using our services, you agree to comply with these Terms. If you do not agree, please discontinue use of our services immediately.


1. General Overview


Calahost provides web hosting services that include server space, bandwidth, and other resources necessary for hosting websites. These services are exclusively intended for website hosting and related activities. We do not offer or support services unrelated to web hosting.


2. Unmetered Hosting Policy


Calahost offers "unmetered" bandwidth and storage with the understanding that these resources are intended for website use only. Our infrastructure is built to scale and meet legitimate website hosting needs. However, all usage must comply with our Fair Usage Policy (see Section 5). Misuse or abuse of resources may lead to account suspension or termination.


3. Appropriate Use of Services


Calahost's hosting services are strictly for website-related activities. Acceptable uses include personal or business websites, blogs, portfolios, e-commerce sites, and other web-based projects. The following activities are prohibited:


        Hosting large media files intended for external websites.

        Using the hosting account for general file storage, backups, or file-sharing services.

        Running excessive scripts, processes, or applications that consume disproportionate server resources (e.g., CPU, memory).

        Using the service for mass email marketing, unsolicited bulk emails (spam), or any kind of mass communication campaigns.


If we determine that your usage violates these terms, we reserve the right to limit, suspend, or terminate your account.


4. Resource Usage & Scripts


While we offer unmetered data, your website must not:


        Use excessive server resources such as CPU, RAM, or network bandwidth, which could affect other customers on the shared server.

        Run continuous or poorly optimized server-side scripts, including PHP, MySQL, or any other code that consumes disproportionate resources.

        Mirror files for external websites or use your hosting for non-web-hosting purposes.


Excessive usage of resources will result in a warning, potential resource restrictions, or account suspension. We monitor server performance to ensure optimal operation for all users.


5. Fair Usage Policy


Our unmetered data plan is designed for typical website hosting use. If your website's traffic or resource usage significantly increases, we will:


        Notify you in advance if you're close to exceeding fair usage limits.

        Collaborate with you to upgrade your server or move your account to a more appropriate server that can handle the traffic or data load.


In cases where repeated excessive resource use negatively impacts server performance or other customers, we may take action to reduce your account's impact, including suspension or termination.


6. Account Suspension and Termination


Calahost reserves the right to suspend or terminate your account if you engage in the following activities:


        Using excessive server resources.

        Violating the Fair Usage Policy.

        Hosting illegal content or engaging in activities that violate local, national, or international laws (e.g., hosting pirated materials, or illegal software).

        Engaging in mass email marketing or sending unsolicited bulk emails (spam).

        Misusing your account for non-website-related purposes.


In case of suspension, we will provide notice and the opportunity to resolve the issue. If the violation continues, permanent account termination may follow.


7. Monitoring and Security


Calahost reserves the right to monitor websites hosted on our servers to ensure compliance with these Terms and ensure the performance and security of our infrastructure. This includes:


        Monitoring server resource usage, traffic, and system performance.

        Investigating any activities that violate these Terms or could compromise server security.

        Scanning for malware, malicious content, or other harmful activities that could impact our services or other users.


By using Calahost services, you consent to such monitoring.


8. Refund Policy


At Calahost, we offer a 14-day refund policy for your first three orders. If you are unsatisfied for any reason, you may request a refund within the first 14 days of your initial purchase for those first three orders.


No refunds will be issued for any subsequent orders after your first three, regardless of the length of service.


Please note that if your account is terminated due to a breach of these Terms (e.g., abuse, excessive resource use, spam), you may not be eligible for a refund. Refunds for terminated accounts are handled at Calahost's discretion and are determined on a case-by-case basis.


9. Data Backup and Responsibility


While we strive to maintain regular backups of all data hosted on our servers, you are solely responsible for maintaining backups of your website content and data. Calahost is not responsible for any data loss due to server failure, hacking, or other unforeseen events.


10. Server Maintenance and Downtime


Calahost performs regular server maintenance to ensure optimal performance. During these times, your website may experience temporary downtime. We will notify you in advance of scheduled maintenance when possible, but emergency maintenance may occur without notice.


Calahost is not liable for any revenue loss, missed business opportunities, or other damages resulting from downtime.


11. Limitation of Liability


Calahost is not liable for any direct, indirect, incidental, or consequential damages that result from the use of our services, including but not limited to:


        Loss of data or website functionality.

        Loss of business or potential revenue due to downtime or interruptions.

        Unauthorized access to your website, data, or server due to hacking or other malicious activities.


12. Amendments to Terms


Calahost reserves the right to modify these Terms at any time. Any changes will be posted on our website, and continued use of our services constitutes acceptance of the revised Terms.
